This Sales Contract (hereafter Sales Contract) is made and entered into force by and between Airoso e-store (hereafter e-Store), the Owner of which is Airoso OÜ, with a registration code 14946979, with a registered address located at Pärnamäe tee 4, 11914 Tallinn (hereafter Seller) and e-Store buyer (hereafter Buyer).
General Provisions
The online store is an e-environment owned by the Seller, through which the products are sold to the Buyer. The e-store is located at www.airoso.ee. The terms and conditions of the Sales Contract are also available to the Buyer in the e-Store in Estonian. The Parties shall be guided by the laws of the Republic of Estonia, by other applicable legislation, and the agreement in the Sales Contract when regulating their mutual relations. The e-Store reserves the right to make changes in the terms and conditions of the Sales Contract, without advance notice. The changes are reflected on the website www.airoso.ee. The Transaction is subject to Terms and conditions valid at the time of the transaction. The Buyer can print out the terms and conditions of the Sales Contract before performing the purchase.
Product Information
The products offered in the e-Store are sold to both natural and legal persons. The photos of the Products displayed in the e-Store have illustrative purposes only and may slightly inadvertently differ from the actual appearance of the Product. The product descriptions in the e-Store may not be exhaustive and may contain unintentional errors. The e-Store displays information on whether the products are in stock or not. Information concerning the availability of products offered in the e-Store may not correspond to reality due to technical reasons. The products in the e-Store are in stock and available and will be delivered to the customer within 1-2 working days. If, after placing the order, it turns out that the product is not available and the order cannot be fulfilled, the Seller shall immediately contact the Buyer and propose a possible new delivery time or replacement of the product with another equivalent product of the same price and quality or refund. The money will be returned to the Buyer immediately, but not later than within 14 days after placing the order.
Price Information
All prices at the e-Store are displayed in euros and include a Value Added Tax according to the rate provided by law. Transportation costs are added to the price of the product. Transportation costs are depending on the delivery location and the selected delivery option. Charge for transport is calculated in the Buyer’s shopping cart. If the Buyer orders a product from the Online Store and the order must be delivered outside the Republic of Estonia, it means that it is an international order, customs or other taxes may be added to the price of the order when the ordered product reaches its destination. The Buyer is obliged to pay any possible additional taxes. If the Buyer picks up the goods at the Seller’s warehouse and the Buyer chooses the specified method of receiving the goods (Self Pick Up), the delivery fee will not be added to the final price of the products. The Seller reserves the right to change the prices unilaterally. If the prices in the e-Store have changed after the Buyer has submitted the order and paid for it, the Seller undertakes to deliver the corresponding products to the Buyer at the prices valid at the time of the order. The Buyer has no right to demand compensation for the price difference.
Placing an Order
To place an order, the Buyer selects the desired product in the Online Store and adds it to the shoppingcart by clicking on the “Add to shopping cart” link. It is possible to change the quantities in the shopping cart and remove the products from the shopping cart until you proceed with the payment of the products. To place an order, you must fill in the required data fields (contact person, telephone, e-mail address), select the delivery and payment method, confirm the review and acceptance of the contract and press the “Secure Payment” button. The Buyer undertakes to provide true information necessary for fulfilling the order when placing the order. The Seller shall not be liable for non-performance of the order due to incorrect data provided by the Buyer during the performance of the order or for any consequences thereof. A Sales Contract is deemed as entered into from the receipt of the amount payable according to the confirmation of the order to the Seller’s bank account.
Payment Methods
Orders can be paid to the Seller’s bank account on the basis of the order confirmation. Orders can be paid for securely using Estonian bank links (Estonia: Swedbank, SEB, Luminor, LHV, Coop Pank, Pocopay). The payment is performed in a secure environment outside the e-Store: in a secure environment of Maksekeskus AS. The Seller does not have any access to the Buyer’s bank details.
Delivery methods
To receive the order, the Buyer selects a suitable delivery method in the shopping cart. The cost of shipping the products shall be borne by the Buyer in accordance with the cost shown next to the method of delivery. The Buyer pays the costs associated with the delivery of the products. The delivery fee depends on the location of the Buyer and the selected method of delivery. The delivery fee is calculated in the shopping cart. The ordered products will be sent to the Buyer at the given address indicated by the Buyer when placing the order. Shipments within Estonia will reach the destination specified by the Buyer within 1-5 working days from the entry into force of the Sales Contract. In case of a special order, the goods can reach their destination up to 7 working days. The Buyer is obliged to make sure that the contact data entered when placing an order are correct in order to prevent delays and misunderstandings in the delivery of the goods. The Seller does not assume any liability for the delayed delivery and misunderstandings if these have been caused by the inaccuracy or incorrectness of the data that you submitted during placing your order. If the Buyer picks up the goods at the Seller’s warehouse and the Buyer chooses the specified method of receiving the goods, the delivery fee will not be added to the price of the goods. Within Estonia, it is possible to order products by Smartpost, Omniva, Smart Courier, and courier (Tallinn and, by agreement, the surroundings of Tallinn). In agreement with the customer, the goods may also be delivered in other ways (for example, in the Seller’s warehouse).
Handover of Goods
Airoso.ee e-Store sells alcoholic beverages, which is why only adults, i.e. 18 years of age and older, are allowed to visit the airoso.ee e-Store and place an order. Withdrawal from a Sales Contract and Return Policy
The Buyer has the right to withdraw from the products purchased through our e-Store without providing a reason within 14 (fourteen) days, if they have not been used, damaged or their appearance has not changed significantly, which means that only such changes have been made to the appearance of the goods or their packaging which were necessary to examine the goods received. The Buyer must exercise this right responsibly and return the goods in the proper original packaging, as well as return all parts included in the set of goods. The costs of returning the goods must be covered by the Buyer. The goods must be returned to the Seller’s service center, which is located at Pärnamäe tee 4a, 11914 Tallinn.
Upon receipt of the returned goods and assessing their quality, the Seller shall return the money paid for the goods and delivery to the Buyer within 14 (fourteen) days of the return of the goods. If only part of the goods is returned, the shipping cost will only be reimbursed if the other goods in the same order, when purchased only, would have been subject to a lower shipping cost than when the goods were returned with the returned goods and only to the extent of that shipping cost. difference. Use of of Personal Data
By agreeing to the terms of the Sales Contract, the Buyer gives clear and informed consent to the Seller for the processing of his/her personal data. The Seller processes the personal data provided by the Buyer in accordance with the legislation regulating the protection of personal data. The personal data to be processed are the data requested from the Buyer when registering as a loyal customer and/or placing an order (first and last name, address, phone number, e-mail address, contents of the shopping cart, and purchase history). The Seller processes the Buyer’s personal data for the management of the customer account, for the fulfillment of orders (incl. Forwarding of notifications related to the order, payment for products, delivery of products), for preparation, and sending of personal offers and conducting inquiries and draw games concerning the Seller.
Storage of Personal Data
The Seller retains the contact details and information about the Purchases made by the Buyer during the purchases. Such kind of information is treated as confidential information and is processed in accordance with the Personal Data Protection Act. The personal data necessary for sending the Products to the Buyer will be forwarded to the company providing the courier service. The data communication between the Customer and banks is encrypted, which ensures the safety of the Customer’s personal data and bank requisites. The payment is made outside the environment of the e-Store, in the secure payment environment of the respective bank or service provider. The Seller does not have any access to the Buyer’s bank details.
Processing of Personal Data
The controller of the personal data of the e-Store is Seller Airoso OÜ, registration code 14946979, with a registered address located at Pärnamäe tee 4, 11914 Tallinn. Airoso OÜ forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS (Pärnu mnt. 139C / Kohila 8, Tallinn, Tel: 6229521, e-mail: support@maksekeskus.ee). The Buyer has the right to inspect his/her personal data at any time and to request the correction, closure, or deletion of such data unless otherwise provided by law. If the Buyer has expressed a wish to receive the Seller’s newsletters and/or personal offers, the Buyer always has the right to cancel them by sending a corresponding notification to the Seller’s e-mail address info@airoso.ee.
Liability
The Seller is only liable for manufacturing defects and other defects that existed when the product was handed over to the Buyer. The Seller is responsible for the sales price of the product. Seller is not responsible for the loss that was made by defective item (e.g., damage to property or information, loss of turnover, or profit). The Seller shall not be liable for non-performance of the order due to incorrect data provided by the Buyer during the performance of the order or for any consequences thereof. The Buyer undertakes to use the e-Store service only in accordance with the law and good practices.
Other Provisions
Disputes arising from the Sales Contract between Seller and Buyer shall be resolved by the parties by way of negotiations. In case of not reaching an agreement, the Parties have the right to turn to the Consumer Complaints Committee of the Consumer Protection Board or the dispute shall be resolved in Harju County Court. Disputes arising from the contract shall be resolved pursuant to legal acts of the Republic of Estonia and as agreed in the Sales Contract. In case of not reaching an agreement, disputes shall be resolved pursuant to legal acts of the Republic of Estonia.
